Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the PersonaQA website, platform and related services (“Service”) operated by One Digital INT Ltd, a company registered in England and Wales (Company No. 09415327), whose registered office is at 20 Wenlock Road, London, N1 7GU, United Kingdom (VAT No. 465 720 579) (“we”, “us”, “our”). By creating an account or using the Service, you agree to be bound by these Terms.
1. Definitions
- “Account” means your registered user account on PersonaQA.
- “Content” means any data, text, URLs, images, or other materials you submit to or generate through the Service.
- “Persona” means an AI-powered testing agent configured with specific behavioural traits, focus areas, and evaluation criteria.
- “Run” or “Test Run” means a single execution of a Persona against one or more URLs you specify.
- “Report” means the AI-generated analysis, feedback, scores, and recommendations produced by a Run.
- “Plan” means the subscription tier you select, which determines your usage quotas and available features.
- “Domain” means a website address (hostname) you register within your Account for testing.
2. Eligibility & Account Registration
2.1 Eligibility
You must be at least 16 years old and have the legal capacity to enter into a binding agreement. If you are using the Service on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.
2.2 Account Security
You are responsible for:
- Providing accurate and complete registration information.
- Maintaining the confidentiality of your login credentials.
- All activity that occurs under your Account, whether or not authorised by you.
You must notify us immediately at contact@persona.qa if you suspect unauthorised access to your Account.
2.3 One Account Per Person
Each individual may maintain only one Account. We reserve the right to merge or terminate duplicate accounts.
3. Service Description
PersonaQA is an AI-powered quality assurance and customer-experience testing platform. The Service allows you to:
- Select or customise AI Personas that simulate different types of website visitors (e.g. first-time customers, security-conscious buyers, UX reviewers).
- Run automated test sessions against publicly accessible URLs you specify.
- Receive page-by-page feedback, executive summaries, actionable recommendations, technical audits, and scored reports.
- Track changes over time through a reporting dashboard.
The Service uses automated browser instances and large language model (LLM) APIs to browse, analyse, and evaluate web pages. Test Runs interact only with publicly accessible pages at the URLs you provide.
4. Subscriptions, Billing & Payments
4.1 Plans & Quotas
The Service is offered through subscription Plans, each with defined usage quotas (e.g. runs per month, pages per run, number of domains, concurrent runs). Your current Plan’s quotas are displayed in your Account dashboard.
4.2 Payment Processing
All payments are processed securely by Stripe, Inc. By subscribing to a paid Plan, you authorise us (via Stripe) to charge your chosen payment method on a recurring basis at the applicable rate. You agree to provide accurate and up-to-date billing information.
4.3 Billing Cycle & Renewal
Subscriptions are billed monthly or annually, depending on the billing cycle you select. Your subscription will automatically renew at the end of each billing cycle unless you cancel before the renewal date.
4.4 Price Changes
We may adjust pricing from time to time. If we increase the price of your Plan, we will provide at least 30 days’ notice before the change takes effect. Continued use after the price change constitutes acceptance of the new pricing.
4.5 Refunds
Subscription fees are generally non-refundable. However, if you experience a significant, verified service outage or defect that we are unable to resolve within a reasonable time, you may request a pro-rata refund for the affected period by contacting contact@persona.qa.
4.6 Cancellation
You may cancel your subscription at any time from your Account settings. Upon cancellation:
- You will retain access to paid features until the end of your current billing period.
- Your Account will revert to the free tier (if available) or become read-only.
- Your existing data and Reports will remain accessible according to our data-retention policy.
5. Free Tier & Access Codes
We may offer a free tier or promotional access codes that grant limited use of the Service. Free-tier and access-code usage is subject to the same Terms, with the following additions:
- Free-tier quotas and features may be changed or withdrawn at any time with reasonable notice.
- Access codes are single-use, non-transferable, and may have expiry dates or usage limits.
- We reserve the right to revoke access codes that are abused or shared in violation of their intended distribution.
6. Acceptable Use
You agree to use the Service in compliance with all applicable laws and our Acceptable Use Policy. Without limiting that policy, you must not:
- Test websites you do not own or have explicit authorisation to test.
- Use the Service to attack, disrupt, or degrade any website or server.
- Attempt to circumvent usage quotas, rate limits, or security measures.
- Reverse-engineer, decompile, or attempt to extract the source code of the Service.
- Resell, sublicense, or commercially redistribute the Service or its output without our prior written consent.
- Use the Service to collect personal data from third-party websites in violation of applicable privacy laws.
- Submit URLs that host illegal content, malware, or phishing pages.
- Create multiple accounts to evade restrictions or abuse free-tier quotas.
We reserve the right to suspend or terminate your Account immediately if we reasonably determine that you have violated this section.
7. Your Content & Data
7.1 Ownership
You retain all rights to the Content you submit (domains, URLs, configurations). You grant us a limited, non-exclusive licence to access, process, and store your Content solely for the purpose of providing the Service.
7.2 Test Run Data
Reports, screenshots, logs, and other outputs generated by the Service from your Runs are considered your data. You may export, share, or delete them at any time via your Account.
7.3 Data Protection
We process your data in accordance with our Privacy Policy. Where you are subject to GDPR or similar legislation, you may be a data controller and we a data processor with respect to any personal data processed through your Test Runs.
7.4 Backup
While we take reasonable steps to protect your data, you are responsible for maintaining your own backups. We are not liable for any loss of data.
8. Intellectual Property
8.1 Our IP
The Service, including its software, design, branding, documentation, Persona configurations, prompts, and proprietary algorithms, is owned by PersonaQA and protected by intellectual property laws. These Terms do not grant you any rights to our trademarks, logos, or brand assets.
8.2 Feedback
If you provide suggestions, ideas, or feedback about the Service, you grant us an irrevocable, royalty-free, worldwide licence to use, modify, and incorporate that feedback into our products and services without restriction or compensation.
9. AI-Generated Output
Reports and recommendations produced by our AI Personas are generated automatically by large language models. You acknowledge that:
- AI output is informational and advisory only. It does not constitute professional advice (legal, security, accessibility compliance, or otherwise).
- AI output may contain inaccuracies, omissions, or subjective assessments. You should independently verify any findings before acting on them.
- We do not guarantee that AI-generated recommendations will improve your website’s performance, conversion rates, or compliance status.
- Scores, ratings, and sentiment labels are relative indicators, not absolute measurements.
10. Service Availability & Support
10.1 Availability
We aim to maintain high availability but do not guarantee uninterrupted or error-free operation. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.
10.2 Scheduled Maintenance
Where practicable, we will provide advance notice of scheduled maintenance that may affect service availability.
10.3 Support
Support is provided via email at contact@persona.qa. Response times and support scope may vary depending on your Plan.
11. Third-Party Services
The Service integrates with third-party providers (Stripe, AWS, LLM APIs, Google OAuth). Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the availability, accuracy, or practices of third-party services.
12. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. To the fullest extent permitted by law, we disclaim all warranties, including but not limited to:
- Implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
- Any warranty that the Service will be uninterrupted, secure, or error-free.
- Any warranty regarding the accuracy, completeness, or reliability of AI-generated output.
- Any warranty that the Service will meet your specific requirements or expectations.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
- PersonaQA shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, revenue, data, business opportunities, or goodwill, arising from or related to your use of the Service.
- Our total aggregate liability for all claims arising from or related to these Terms or the Service shall not exceed the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) £100.
- These limitations apply regardless of the theory of liability (contract, tort, negligence, strict liability, or otherwise) and even if we have been advised of the possibility of such damages.
Nothing in these Terms excludes or limits liability for: (a) death or personal injury caused by negligence; (b) fraud or fraudulent misrepresentation; or (c) any other liability that cannot be excluded by law.
14. Indemnification
You agree to indemnify, defend, and hold harmless PersonaQA and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from:
- Your use of the Service.
- Your violation of these Terms or any applicable law.
- Your testing of websites you are not authorised to test.
- Any third-party claim related to the Content you submit.
15. Termination
15.1 By You
You may close your Account at any time by contacting us or using the Account settings. Active subscriptions should be cancelled before closing your Account to avoid further charges.
15.2 By Us
We may suspend or terminate your access to the Service at any time if:
- You breach these Terms or the Acceptable Use Policy.
- Your Account is used for fraudulent or illegal activity.
- We are required to do so by law.
- We discontinue the Service (with reasonable notice).
15.3 Effect of Termination
Upon termination:
- Your right to use the Service ceases immediately.
- We may delete your Account data after a reasonable retention period (see our Privacy Policy).
- Sections that by their nature should survive termination (including Disclaimers, Limitation of Liability, Indemnification, and Governing Law) will remain in effect.
16. Governing Law & Disputes
These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
Before initiating formal proceedings, you agree to attempt to resolve any dispute informally by contacting us at contact@persona.qa. We will endeavour to resolve the matter within 30 days.
17. Changes to These Terms
We reserve the right to modify these Terms at any time. When we make material changes, we will:
- Update the “Last updated” date at the top of this page.
- Notify you by email or in-app notification at least 14 days before the changes take effect (for material changes).
Your continued use of the Service after the effective date constitutes acceptance of the updated Terms. If you do not agree with the changes, you should stop using the Service and close your Account.
18. General Provisions
- Entire agreement: these Terms, together with the Privacy Policy, Cookie Policy, and Acceptable Use Policy, constitute the entire agreement between you and PersonaQA regarding the Service.
- Severability: if any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
- Waiver: our failure to enforce any provision of these Terms does not constitute a waiver of that provision.
- Assignment: you may not assign or transfer your rights under these Terms without our written consent. We may assign our rights and obligations without restriction.
- No agency: nothing in these Terms creates a partnership, joint venture, agency, or employment relationship between you and PersonaQA.
- Force majeure: we shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including natural disasters, pandemics, war, terrorism, strikes, or infrastructure failures.
